Terms of Service
The agreement between you and us when you buy something here.
Who you are dealing with
www.winniescollectables.com is operated by Goodway LLC, doing business as Winnie's Collectables, a family-run business selling trading cards and related products. In these terms “we” and “us” mean Goodway LLC, doing business as Winnie's Collectables, and “you” means the person placing an order.
These terms apply to every order placed through the site. Please read them — particularly the sections on availability and on returns, which differ from what you may expect elsewhere.
What we sell, and how it is described
We sell individual trading cards, and assembled decks and sealed products where we have them. Cards are second-hand goods: each one is an individual object with its own wear.
Condition is assessed by hand against the standard ladder — Near Mint, Lightly Played, Moderately Played, Heavily Played, Damaged. Grading is a judgement, not a measurement. We grade conservatively and list the lower grade where a card sits between two, but reasonable people can disagree about a corner, and we would rather you tell us than keep a card you are unhappy with.
Photographs are our own, taken of cards we hold. Where we have more than one copy of a card the photograph shows one of them rather than the specific copy reserved for you. Ask before you buy and we will send a picture of the exact card.
Where we sell sealed product, we guarantee it is factory sealed unless the description clearly says otherwise — if a description does not say a product is unsealed, it is sealed.
Some products are described by what they contain rather than by a fixed list — a mystery lot, for example, states its size and what is guaranteed inside it. The individual cards in such a product are selected when it is packed, and the description is what we are promising, not any particular card.
Orders, and when a contract is formed
Placing an order is an offer to buy. We accept that offer when we dispatch the goods, and it is at that point a contract is formed — not when the order is placed and not when payment is authorised.
We may decline an order. The usual reasons are that the item is no longer available, that we cannot verify the payment or the delivery address, or that the price shown was wrong.
We try hard to price accurately, but a card listed at an obviously mistaken price — a decimal in the wrong place — is not something we are obliged to honour. If we spot an error after you have paid, we will contact you and either confirm the correct price or cancel and refund in full. We will not simply ship you something different.
Availability, and why an item can sell after you order it
This is the part most likely to surprise you, so it is worth stating plainly. We sell the same physical stock through more than one channel — this site and online marketplaces. Our inventory systems talk to each other continuously, but two people can still buy the same card within the same moment.
If that happens and we cannot fulfil your order, we will tell you promptly and refund that item in full. We will not substitute a different card, a different condition, or a different printing without asking you first.
Prices and payment
Prices are in US dollars and exclude shipping and any applicable sales tax, both of which are shown at checkout before you pay.
Payment is handled by our payment processor. Card details are entered directly with them and are never sent to or stored on our systems — we retain only the card brand, the last four digits, and the processor’s reference for the transaction, which is what lets us match a payment to an order and issue a refund.
Shipping
Orders are dispatched within 3 business days — most ship the next business day; weekend orders start Monday. Shipping is a flat rate per order and free above the threshold shown at checkout.
Singles are sleeved, placed in a rigid holder and sent in a rigid mailer. Orders above $50 are sent with tracking as standard.
Risk passes to you on delivery. If a parcel is lost or damaged in transit, that is ours to resolve — tell us and we will.
Returns
We do not accept returns. Every sale is final — singles, decks and sealed product alike. We are a two-person operation and these are fragile, individually graded goods; once one has left us we cannot reliably take it back because you have changed your mind. Use the condition, the photographs, and any question you care to ask us before you buy — after you buy, the decision is settled.
Sealed product is final in a stronger sense again: a sealed box is a wager on what is inside it, and that wager is yours from the moment you buy, whether or not you ever open it.
If your order arrives damaged, tampered with, or not as described
This is separate from returns, and it is not one. It is our guarantee that what arrives is what you paid for — and if it is not, then we did not deliver, so putting it right is ours to do rather than yours to absorb. It applies to everything we sell, sealed product included.
We will refund or replace, and cover any return shipping, if:
- it arrived damaged, or the parcel never arrived
- a sealed product arrived not factory sealed — opened, resealed or tampered with
- it was not as described — most often, we graded a card wrongly
- we sent the wrong item
Tell us within 7 days of delivery, with a photograph where you can. We are not going to argue with you over a bent corner.
None of this affects any rights you have under consumer law that cannot be excluded by agreement.
Cancelling an order
You can cancel any time before dispatch — email us and we will refund in full. After dispatch, the returns section above applies.
Using the site
Please do not attempt to disrupt the site, access parts of it you have not been given access to, or extract its contents in bulk by automated means. Ordinary browsing, and ordinary use of the search, is exactly what it is for.
Intellectual property
Pokémon and all associated names, characters and card designs are trademarks and copyright of Nintendo, Creatures Inc. and GAME FREAK inc. We are an independent seller of second-hand trading cards. We are not affiliated with, endorsed by, or sponsored by The Pokémon Company or any of its affiliates.
The site's own text, photography and design are ours.
Liability
We are responsible for getting you the goods you paid for, in the condition described, or for putting it right if we do not. We are not responsible for indirect or consequential losses — for example, the value a card might have reached had it arrived sooner.
Nothing here excludes liability for fraud, or for anything else that cannot lawfully be excluded.
Changes to these terms
We may update these terms. The version that applies to your order is the one published when you placed it. Material changes will be noted here with a new date.
Governing law and contact
These terms are governed by the laws of the State of California, and any dispute will be heard in the state or federal courts located in Santa Clara County, California.
Questions, problems and complaints all go to the same place: [email protected]. A person reads it.
The help pages answer the same questions in plainer language. Where they and this document differ, this document is what governs the sale.
